“Ugh! Another pothole just messed up my car!”

This common frustration leads to costly repairs. But did you know you can actually get the city to pay for pothole damage? Knowing your rights and what to do can make getting money back way easier.

STEP 1: Report it ASAP with proof

Don't just drive off if a pothole damages your car. Stop and capture some clear photos and videos of the pothole, showing where it is and when you took the shots.

Also, photograph the damage to your car. This stuff is super important. If you need to, tell the police so there's an official record.

Step 2: Complain to the responsible authority people

Figure out who's in charge of the road – like the city municipal corporation, the Public Works Department or the highway authority. Then, make a real complaint online or at their office, and attach all your proofs. Keep copies of everything for yourself.

Step 3: Get a damage estimate and repair bill

Take your car to a good mechanic and get them to write up exactly what's wrong and how much it will cost to fix. This paper will back up your claim and show how much the pothole cost you.

Step 4: Demand compensation the legal way

If the city ignores you, you can send them a legal notice or file a petition saying they didn't do their job right.

According to the Consumer Protection Act, you can file a complaint under ‘deficiency in service’. You might get anywhere from ₹10,000 to ₹2 lakh, depending on how bad the damage is.

Your fundamental right to safe roads

The courts have said over and over that having safe roads is a basic right. The government is responsible for taking care of roads, and if they don't, they can be forced to pay up.

It might take a little work, but knowing these steps means you can get what you deserve if a pothole messes up your car. So, next time you hit one, remember: it's not just bad luck. It’s their fault, and you can fight for justice and get paid!
